 Key changes are made by a contentious bill to replace the Delhi Ordinance.

The Government of National Capital Territory of Delhi (Amendment) Bill has one provision added and three provisions deleted.


In New Delhi: The draft, which intends to replace the ordinance for the control of services and officers' posting in Delhi, has undergone a number of significant amendments, according to official sources.


The draft bill has been distributed to the lawmakers; it is scheduled to be presented to Parliament this week by Home Minister Amit Shah.



The Government of National Capital Territory of Delhi (Amendment) Bill has had three clauses added and one provision removed. 



The bill omits one of the disputed clauses of the Ordinance that prohibited the Delhi Assembly from passing any legislation pertaining to "State Public Services and State Public Service Commission."


According to a recently added clause in the law, the Lieutenant Governor will appoint members to boards and commissions established by the Delhi government based on a list of candidates proposed by the National Capital Civil Service Authority, which is made up of the Delhi Chief Minister.


The recent flashpoint in the dispute between the Delhi government and the Centre over who will have authority over the bureaucrats in the capital was the selection of the head of the city's power regulator.


To overturn a Supreme Court ruling that stated the elected Delhi government has power over the transfer and employment of bureaucrats, the Centre recently passed the ordinance.


The Arvind Kejriwal administration and the Center are at odds with each other over the divisive measure. The BJP has been charged by the Aam Aadmi Party with attempting to undermine the rule of law while attempting to seize control of police in the capital. To win their support, Arvind Kejriwal traveled the nation, meeting with various chief ministers and opposition party leaders.

Omissions:

1. The bill has eliminated the phrase "Additional provisions with regard to Delhi Legislative Assembly" that was added as Section 3A through the Ordinance. The ordinance's Section 3A stated: "The Legislative Assembly shall have the ability to make legislation as per Article 239AA, save with respect to any matter specified in Entry, notwithstanding anything included in any judgment, order, or decree of any Court.

2. Provision requiring the National Capital Civil Service Authority to submit its "annual report" to the Delhi assembly and to Parliament.


3. The Lieutenant Governor and the Chief Minister of Delhi must be consulted before ministers issue instructions or directives pertaining to projects or issues that must be addressed to the central government.



Addition:



1. The National Capital Civil Service Authority shall recommend a panel of names for the Lieutenant Governor to nominate to Boards or Commissions created by laws passed by the Delhi Assembly.



Concerning the Supreme Court



The Delhi administration would be in charge of all services provided in the national capital, with the exception of those related to public order, land, and the police, the Supreme Court ruled in May.



The Center has now requested that the judgment be reviewed. The Arvind Kejriwal administration, for its part, has petitioned the Supreme Court to overturn the ordinance that the federal government issued shortly after the significant court decision.

The Delhi administration was told that the constitution bench would look into whether Parliament could "abrogate the constitutional principles of governance" by passing a statute to limit its ability to provide services.
